This Brokerage Fee Schedule (“Appendix A”) is incorporated into and forms part of the Easy Realty Office Policy Manual and Independent Contractor Agreement.
The Office Policy Manual governs the interpretation, administration, and enforcement of this Appendix.
The Brokerage reserves the right to amend this Appendix from time to time in accordance with the Office Policy Manual. Associates will be provided notice of material changes. Continued affiliation with the Brokerage constitutes acceptance of any revised version of this Appendix.
All fees, surcharges, deductions, charges, obligations, reimbursements, and payment responsibilities described in this Appendix may be deducted from commissions, referral fees, rental commissions, bonuses, incentives, reimbursements, revenue share payments, and any other compensation payable to the Associate.
Sales Transactions #
Brokerage Transaction Fee
A Brokerage Transaction Fee of $495.00 shall be charged on each closed sales transaction.
Brokerage Variable Cost Surcharge
A Brokerage Variable Cost Surcharge equal to one percent (1.00%) of the gross commission earned shall be charged on each closed sales transaction.
The surcharge is intended to offset variable operating costs incurred by the Brokerage, including technology platforms, software subscriptions, cybersecurity measures, transaction processing, compliance administration, insurance costs, payment processing expenses, and other brokerage operating expenses.
Rental Transactions #
Rental Brokerage Fee
A Brokerage Fee equal to fifteen percent (15%) of the gross commission earned shall be charged on all rental transactions.
This fee applies to residential and commercial lease transactions unless otherwise approved in writing by the Broker.
Referral Transactions #
Referral Brokerage Fee
A Brokerage Fee equal to fifteen percent (15%) of the gross referral fee received by the Brokerage shall be charged on all referral transactions.
The fee shall be calculated before payment of any compensation to the Associate.
Payment Processing Fee #
Payment Processing Fee
A Payment Processing Fee of $25.00 shall be charged whenever funds are received by the Brokerage and the Brokerage is required to process and issue a separate payment to an Associate, broker, vendor, referral recipient, or other third party outside of a standard closing disbursement process.
Examples include, but are not limited to:
- Referral fees received by the Brokerage
- Referral commissions payable to another brokerage
- Rental commissions received by the Brokerage
- Commission payments received after closing
- Direct commission payments not paid through a closing agent or Commission Disbursement Authorization (CDA)
- Commission corrections or reissued payments
- Other funds requiring separate receipt, accounting, processing, and disbursement by the Brokerage
The Payment Processing Fee may be deducted from the applicable payment, charged to the Associate, collected from transaction proceeds, or otherwise assessed by the Brokerage.
The Broker may waive the Payment Processing Fee at the Broker’s sole discretion.
Additional Charges #
Associates remain responsible for actual costs, fines, fees, expenses, reimbursements, and obligations attributable to the Associate, including but not limited to:
- MLS fines and penalties
- Regulatory fines and penalties
- Returned payment fees
- Wire transfer fees
- Chargebacks
- Compliance-related expenses caused by the Associate
- Costs associated with correcting transaction deficiencies
- Transaction-specific expenses approved by or incurred on behalf of the Associate
- Amounts otherwise owed to the Brokerage
Commission Advances #
If the Brokerage advances funds or incurs expenses on behalf of an Associate, the Associate authorizes the Brokerage to recover such amounts from future commissions or other compensation payable to the Associate.
Chargebacks and Reversals #
The Associate remains responsible for commissions, bonuses, incentives, referral fees, rental commissions, or other compensation previously paid if a transaction is canceled, rescinded, refunded, reversed, subject to repayment, or otherwise results in recovery of funds by the Brokerage.
The Brokerage may deduct such amounts from future compensation payable to the Associate.
Collection Authorization #
The Associate expressly authorizes the Brokerage to deduct any amount due under this Appendix A, the Office Policy Manual, the Independent Contractor Agreement, or any other written agreement between the parties from any compensation payable to the Associate.
If compensation is insufficient to satisfy amounts due, the Associate remains personally responsible for the unpaid balance.
Broker Discretion #
The Broker reserves the right to waive, reduce, modify, refund, or adjust any fee described in this Appendix on a transaction-specific basis when the Broker determines such action to be in the best interests of the Brokerage.
No waiver or exception granted in one transaction shall create an obligation to provide the same waiver or exception in any other transaction.
Questions Regarding Fees #
Questions regarding fees, deductions, calculations, reimbursements, or transaction-specific charges should be directed to the Brokerage’s accounting or compliance department.
